These terms apply when you use FitU Apex ("Apex", "we") at https://fit-u-apex.vercel.app. By creating an account you agree to them and to our Privacy Policy.
Who can use Apex
You must be at least 16. If you are 16 to 18, a parent or guardian must consent before you use Apex. You're responsible for keeping your sign-in secure and for what happens under your account.
Not medical advice
Apex, including the AI Coach, agents, meal plans and coaches, gives general fitness and nutrition guidance. It is not medical advice and doesn't diagnose or treat any condition. Talk to a doctor before starting a new exercise or diet program, and stop and get help if you feel pain, dizziness or shortness of breath. If your Readiness Check flags a concern, workouts stay at low intensity until you have a doctor's clearance. AI answers can be wrong: check anything important, and always check meal plan ingredients against your allergies.
Plans and billing
- Free is free. PRO is $29, Pro+ is $99 and Executive is $299 a month, plus any add-ons you choose. Prices are in US dollars; taxes may apply.
- Executive is by application. We review applications and may decline them.
- Paid plans renew every month until you cancel. Stripe charges your card; you can change or cancel your plan from the Plans page. When you cancel, your plan stays on until the end of the period you've paid for, and we don't refund partial months.
- We may change prices with notice in the app before your next renewal.
1-on-1 coaching sessions
You can cancel a session up to 24 hours before it starts. A paid session cancelled in time is refunded what it cost; an included session goes back to your month. If your coach cancels, you're refunded. Sessions are not recorded.
Shopping at Kroger
On Pro+, you can send your grocery list to your own Kroger cart. Your purchase is between you and Kroger, under Kroger's terms. Prices and availability come from Kroger and can change at checkout. Apex never places orders or takes payment for groceries.
Pods, messages and coaches
Be respectful in Pods and sessions. Don't post anything unlawful, hateful, harassing or sexual, or anyone else's private information. A Pod's coach can remove members, and we can remove content or accounts that break these rules. Coaches are independent and are responsible for their own advice.
Your content
What you log and write stays yours. You let us store and process it to run Apex for you, as described in the Privacy Policy.
Acceptable use
Don't misuse Apex: no attempts to break in, scrape, overload or reverse engineer the app, no reselling access, and no use that breaks the law.
Ending your account
You can stop using Apex at any time and ask us to delete your account (see the Privacy Policy). We may suspend or close accounts that break these terms.
Disclaimers and limits
Apex is provided "as is". To the extent the law allows, we don't promise it will be uninterrupted or error-free, and we aren't liable for indirect or consequential losses or for injuries from exercise or diet choices you make. Our total liability to you is limited to what you paid us in the 12 months before the claim.
Changes
We may update these terms. We'll post the new version here and update the date above; using Apex after that means you accept them.
